BluRhyn Interactive Private Limited and our subsidiaries (“we,” “us”, “our”, “the company” or “BluRhyn”) are a provider of tools and services for businesses to establish and build their online presence, implement software technologies in their business, improve brand visibility, get found in online search, and connect with customers through digital marketing, social media, and more. We care about protecting the personal information of our customers and visitors who use our websites, products or services (“you”, “your”, “the client”, or collectively, our “Users”). This privacy policy provides details about how your personal information is collected, shared and used by us.

This privacy policy details what information we require from you, why we require this information, and how we use, share, store, and secure your information. Under the General Data Protection Regulation (“GDPR”) established by the European Union, BluRhyn Interactive is the data controller.

Scope of Data

This policy outlines the personal data collected from you during sign-up, use of our services, support communications, website visits, or other interactions that occur during the normal operating procedure of the company. This policy applies to and governs all divisions, subdomains, and aspects of the company or its services in equal measure.

This policy does not outline the personal data or content you, as a client, upload, share, display, or store on the website or server space provided to you by use of our services. We strongly advise that any business or individual using our services and subject to the GDPR develop their own GDPR-compliant privacy policy and security measures for personal data.

Information We Collect

We may collect information about you in a variety of ways. The information we may collect on the Site includes:

Personal Data

Personally identifiable information, such as your name, shipping address, email address, and telephone number, and demographic information, such as your age, gender, hometown, and interests, that you voluntarily give to us when you register with the Site or our mobile application, or when you choose to participate in various activities related to the Site and our mobile application, such as online chat and message boards. Derivative Data 

Information our servers automatically collect when you access the Site, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Site. If you are using our mobile application, this information may also include your device name and type, your operating system, your phone number, your country, your likes and replies to a post, and other interactions with the application and other users via server log files, as well as any other information you choose to provide.

Financial Data

Financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from the Site or our mobile application. We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor, Razorpay, CCAvenue, Paypal, Stripe, and you are encouraged to review their privacy policy and contact them directly for responses to your questions.

Facebook Permissions 

The Site and our mobile application may by default access your Facebook basic account information, including your name, email, gender, birthday, current city, and profile picture URL, as well as other information that you choose to make public. We may also request access to other permissions related to your account, such as friends, check ins, and likes, and you may choose to grant or deny us access to each individual permission. Data From Social Networks 

User information from social networking sites, such as Apple’s Game Center, Facebook, Google+, Instagram, Pinterest, Twitter, including your name, your social network username, location, gender, birthdate, email address, profile picture, and public data for contacts, if you connect your account to such social networks. If you are using our mobile application, this information may also include the contact information of anyone you invite to use and/or join our mobile application.

Mobile Device Data 

Device information, such as your mobile device ID, model, and manufacturer, and information about the location of your device, if you access the Site from a mobile device.

Third-Party Data 

Information from third parties, such as personal information or network friends, if you connect your account to the third party and grant the Site permission to access this information.

Data From Contests, Giveaways, and Surveys 

Personal and other information you may provide when entering contests or giveaways and/or responding to surveys.

Mobile Application Information

If you connect using our mobile application:

  • Geo-Location Information. We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using our mobile application, to provide location-based services.   • Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device’s Bluetooth, calendar, camera, contacts, microphone, reminders, sensors, SMS messages, social media accounts, storage, and other features.   • Mobile Device Data. We may collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address.
  • Push Notifications. We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

The company has accounts on various social media platforms, such as Facebook, Twitter, and LinkedIn, that you may visit, interact with, comment on, or contact us through. When you do so, certain personal data on the relevant social media platform may become available to us. The data we are allowed to access is determined by the social media platform you are using and your privacy settings on that platform. How We Store Your Data

Your personal data is stored securely in various locations depending on the data, its source, and its use. The Site is secured via HTTPS/SSL encryption, server-side security features, and other advanced software to protect against unauthorized access.

We use WHMCS as our billing system, which stores the majority of your billing and contact information. WHMCS is coded in Laravel, and all pages of WHMCS are heavily encrypted as proprietary technology, even to us. WHMCS is GDPR-compliant. We use ResellerClub as our domain registrar, which stores your domain registrant information if you have registered a domain through us. To learn more about how ResellerClub secures and protects your personal data, please see the ResellerClub Privacy Policy.

Third-Party Service Providers

We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance. 

The below companies may collect personal information when you interact with our digital property, including IP addresses, digital identifiers, information about your web browsing and app usage and how you interact with our properties and ads for a variety of purposes, such as personalization of offers or advertisements, analytics about how you engage with websites or ads and other commercial purposes. ResellerClub

We are a reseller of ResellerClub domain names. When you purchase a domain, a domain registrar is required to register the domain on your behalf, for use on the internet by the domain registrant (you). When you purchase a domain from us, we send an automated request with your domain name, TLD, registration period, and registrant information to ResellerClub.

ResellerClub requires this data about you to authorize and validate you as the registrant (owner) of the domain name, and perform the following actions:

  • Check the domain name against a database of every domain name currently registered on the internet
  • Check the TLD or domain extension for special requirements, and if these requirements are met, such as in the case of country-code domains
  • Validate that the registrant contact information (personal data) provided is complete and corresponds to a real address and location
  • Contact you via the registrant email address for your consent or approval to register, renew, transfer, or alter this domain
  • Ensure that the domain name meets any additional laws or requirements as laid out by ICANN, the governing body of all domain names

A domain name cannot be registered unless it meets the above requirements. We do not share your data with ResellerClub unless you purchase or currently own a domain name registered by ResellerClub.

WHMCS

We use WHMCS to store, access, and manage the profile information of all our web-hosting clients. The WHMCS hosting automation software is proprietary, meaning the internal mechanisms are encrypted and kept private, even from us. Due to this privatization, errors and bugs occurring within the WHMCS installation we run cannot always be fixed by our employees or developers.

In the event one of these errors occurs in our internal system and affects our ability to provide you with full service, we may provide WHMCS with temporary access to our WHMCS installation for the purpose of investigating, troubleshooting, and fixing the error in our installation of their software. This access potentially allows them to view some areas of your personal data as it is reflected in our system. Access to our system is revoked and deleted when the error is resolved.

WHMCS is GDPR-compliant.

WordPress

When you install or sign up for the WordPress CMS for use with our services, you may be required to enter limited personal data for your WordPress account. Most WordPress problems and changes can be successfully completed or resolved by us, but in the rare event that your WordPress account experiences an error that we cannot fix, we may request additional support from WordPress. In the process of providing support, WordPress may temporarily access the personal data you provided on your WordPress account, such as your contact email address or information you have posted to your WordPress website.

Weebly

When you install or sign up for the Weebly website builder we offer for use with our services, you may be required to enter limited personal data for your Weebly account. Most Weebly problems and changes can be successfully completed or resolved by us, but in the rare event that your Weebly account experiences an error that we cannot fix, we may request additional support from Weebly. In the process of providing support, Weebly may temporarily access the personal data you provided on your Weebly account, such as your contact email address or information you have posted to your Weebly website.

cPanel

When you sign up for hosting, we provide you with your own version of cPanel, a control panel for web hosting accounts that easily displays the settings and management areas of your website. cPanel may have limited access to data stored on your cPanel, such as your name, email address, or IP Address, in the event that cPanel is granted access to one of our servers to fix a problem with their product or services.

DigiCert

When you purchase an SSL Certificate or a Wildcard SSL,  The company purchases the SSL from the Certificate Authority SSL Vendor, DigiCert. In order for your SSL to be configured and set up, some personal data is required, such as your email address, geographical location, and company name, division, or industry if applicable. This data is used solely to set up and enable your SSL Certificate and is not shared beyond that.

SendGrid

We use SendGrid for its newsletter program. When you use a form field on our website, order form, or elsewhere to opt-in to marketing communications from us, the data is received by our SendGrid account for addition to our mailing list, including your email address. We only use this data to send you the marketing communications to which you opted-in. SendGrid is GDPR-Compliant.

Marketing Communications

With your consent, or with an opportunity for you to withdraw consent, we may share your information with third parties for marketing purposes, as permitted by law.

Interactions with Other Users

If you interact with other users of the Site and our mobile application, those users may see your name, profile photo, and descriptions of your activity, including sending invitations to other users, chatting with other users, liking posts, following blogs.

Online Postings

When you post comments, contributions or other content to the Site or our mobile applications, your posts may be viewed by all users and may be publicly distributed outside the Site and our mobile application in perpetuity.

Third-Party Advertisers

We may use third-party advertising companies to serve ads when you visit the Site or our mobile application. These companies may use information about your visits to the Site and our mobile application and other websites that are contained in web cookies in order to provide advertisements about goods and services of interest to you.

Offer Wall 

Our mobile application may display a third-party hosted “offer wall.”  Such an offer wall allows third-party advertisers to offer virtual currency, gifts, or other items to users in return for acceptance and completion of an advertisement offer.  Such an offer wall may appear in our mobile application and be displayed to you based on certain data, such as your geographic area or demographic information.  When you click on an offer wall, you will leave our mobile application.  A unique identifier, such as your user ID, will be shared with the offer wall provider in order to prevent fraud and properly credit your account.    

Social Media Contacts 

If you connect to the Site or our mobile application through a social network, your contacts on the social network will see your name, profile photo, and descriptions of your activity.

Other Third Parties

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.

Sale or Bankruptcy

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity.  If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party.  You acknowledge that such transfers may occur and that the transferee may decline honor commitments we made in this Privacy Policy.

We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations. We fully comply with law enforcement and legal entities. In the event your personal data or account is involved in a police investigation, legal proceedings, or there is a subpoena for the data we have collected from you, any and all necessary and required data will be shared with relevant parties such as law enforcement officials, attorneys, courts of law, or other relevant and authorized parties.

Tracking Technologies

Cookies and Web Beacons

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Site and our mobile application to help customize the Site and our mobile application and improve your experience. By accessing the Site, our mobile application, you consent to the collection and use of your information by these third-party vendors. How We Secure Your Data

Online forms of communication are never completely secure or protected due to the nature of technology. We will take every available measure to protect and keep private your data, but we cannot make any guarantees. Data you choose to transmit over the internet is done so at your own risk. Please never send your credit card information by email or chat. No BluRhyn employee will ask you to do so. Please only enter billing information from the section in your secure client billing area, or via phone to a BluRhyn employee if absolutely necessary. Financial data such as credit card numbers received via proper methods are immediately encrypted and protected during and after transmission.

When we receive data transmitted to us, all applicable and necessary data security measures are taken to prevent your data from loss, theft, or unauthorized use, modification, or access.

Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and our mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected.  No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.  If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy./Most web browsers and some mobile operating systems and our mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. If you set the DNT signal on your browser, we will respond to such DNT browser signals.

Options Regarding Your Information

Account Information

You may at any time review or change the information in your account or terminate your account by:

  • Logging into your account settings and updating your account
  • Contacting us using the contact information provided below

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

Phone

We will not call you with marketing offers, advertising, or for any other reason than to follow up with you regarding a recent support ticket or problem with your account, or if you requested a call from us. If you do not wish to be called about support tickets or chats you have submitted, please state as such in your email or chat so that we may note your choice.

Email

To opt-out of our Newsletter or any other marketing communication from us, please use the link contained in the footer of the email where you may change your email preferences or unsubscribe. Alternatively, you may email [email protected] at any time to request which data you would like removed or changed.

Important information about your account and billing notifications are not included in this opt-out procedure. To stop receiving service-related emails or renewal notifications, you will need to cancel your account. Cancellation instructions and procedure can be found in the Billing Policy of the brand or by emailing billing support at the brand on which the account or profile is located.

If you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly.

Social Media

To opt-out of social media posts or notifications from one of our Social Media profiles, please unfollow, unsubscribe, mute, or otherwise remove our social media account using the preferences and options provided by the social media platform in question.

Unauthorized Access

If your account, website, or personal data is accessed by someone without your knowledge or consent, or if a sub-account or additional account is created using your personal data without your consent, please contact customer support at the brand on which the account or profile is located to secure your account and request removal of the data or account in question.

How We Keep Your Data

We keep your personal data stored in our secure system when necessary to provide you with service, comply with legal obligations, resolve account ownership or payment disputes, notify you of important information pertaining to your services and their billing, keep your services active and working until you choose to cancel them, and to enforce our terms of service and billing policy.

Should you wish to alter how or how long your personal data is stored, please contact customer support at the brand on which the account or profile is located to request the steps you must take to make these changes.

Legal Basis for Processing Data

We process your data for the following reasons under the GDPR, with variations depending on what data we have collected from you and how we have collected it:

  • To administer our contractual relationship, including setup and continuous provisioning of your service, payments, renewals, and features.
  • To serve our legitimate interest in successfully providing you with reliable and efficient hosting, relevant content about your services, and succeed as a hosting company.

  • Because you have given us consent to do so in order to provide you with the service you have requested.

Your Rights

Under the GDPR, you have certain rights and control over your personal data as it is stored or accessed in our system. You may exercise your rights in the following ways if you are able to verify your identity with information that only the account owner would know. The company may deny you access based on inability to verify your identity or other behaviors or patterns that give us a legal basis to deny access to an account. You will be informed of the reason why your access is being denied, and given options to help resolve this if possible.

We verify account ownership using one or a combination of the following personal information:

  • The billing address on file, including the number, street, city, and zip as applicable
  • The last 4 digits ONLY of the credit card on file
  • One or multiple invoice numbers, and information about the items of the invoice if available

You have the right to know if we process your personal data, and to access any data we hold on you, as well as who we share this data with and how we use the data we have collected.

You may access and view your own data at any time by logging into your client area.

You have the right to receive a machine-read file containing your personal data, transmitted online via the method of your choice, delivered to yourself or to a third party as specified. We are not responsible for the processing or transmission security of the data you request to be sent to a third party or to yourself, if it is compromised as a result of your request.
